ACT NO 14 of 2014 Revised 2019
REGULATIONS FOR REGISTRATION & LICENSING OF COUNSELLORS AND PSYCHOLOGISTS (2023)
1.Short title
These Regulations may be cited as the Registration of Counselors and Psychologist Regulations,2023.
2.Interpretation
“Board” means the Counsellors and Psychologists Board established under section 3 of the of the Counselors and Psychologists Act (No. 14 of 2014) Revised Edition 2019 [2014].
"register" means the register of counsellors and psychologists maintained under section 25 of the of the Counselors and Psychologists Act (No. 14 of 2014) Revised Edition 2019 [2014].
"Registrar" means the Registrar of Counsellors and Psychologists appointed under section 9 of the same Act; and The expressions "legally qualified counsellor or psychologist" and "duly qualified counsellor or psychologist" or any words importing a person recognized by law as a counsellor or psychologist or a member of the professions of counselling and psychology, when used in a written law with reference to that person, shall be construed to mean a person registered as a counsellor or psychologist under
this Act or, where the context so admits, a person who is registered by the Board under section 24 of the of the Counselors and Psychologists Act (No. 14 of 2014) Revised Edition 2019 [2014].
3.Preamble
Section 6 (d) and (c) of the Counselors and Psychologists Act (No. 14 of 2014) Revised Edition 2019 [2014] mandate the Board to (c) register and license counsellors and psychologists for the purposes of this Act upon payment of the prescribed fees.
4.Qualifications for registration
(a) is, in the case of a counsellor, the holder of a diploma, degree in counselling from a recognized TIVET or university.
(b) is, in the case of a psychologist, the holder of a diploma, degree in psychology from a recognized university.
(c) has passed an examination prescribed by the Board; and
(d) satisfies the Board that he or she is a person of good moral character and a fit and proper person to be registered as stipulated in the Counselors and Psychologists Act (No. 14 of 2014) Revised Edition 2019 [2014].
(e) for the purpose of the first registration of counsellors and psychologists, a person qualified as a counsellor or psychologist shall be exempted from the requirements of section (c) above in accordance with the Counselors and Psychologists Act (No. 14 of 2014) Revised Edition 2019 [2014].
(f) a person who immediately before the first registration was engaged in private practice as a counsellor or psychologist shall be entitled to continue in such practice without a license, until the license is granted or finally refused, or the application is withdrawn.
5.Process of Registration
Every person eligible to be registered as a counsellor or psychologist may apply electronically using forms (1A,1B or 1C) to the Registrar for registration in the register. Every such application shall be accompanied by the following:
a) Certified copies of relevance academic and professional certificates
b) Receipt/proof of payment of registration fee as specified in these regulations no: 8
Where a person has complied with the provisions of these regulations and has been accepted by the Board as being eligible for registration and has satisfied the Registrar that he or she has been so accepted, he or she shall be registered.
The Registrar shall issue to every person registered under the Counselors and Psychologists Act (No. 14 of 2014) Revised Edition 2019 [2014] with a certificate of registration.
6. Register of counsellors and psychologists
The Registrar shall maintain a register of counsellors and psychologists in the prescribed form in which the name of every person registered shall be entered.
7. Alterations of the register
The Registrar shall, from time to time, in accordance with the directions of the Board, make any corrections in that register in relation to any entry therein.
All changes in the entries shall be made by the Registrar as soon as is practicable after receipt of the notification thereof.
The Registrar shall remove from the register—
(a) the name of every—
(i) deceased person.
(ii) person convicted of an offence under the Counselors and Psychologists Act (No. 14 of 2014) Revised Edition 2019 [2014] and all avenues of appeal have been exhausted.
(iii) person whose name the Board has, under section 34 of the Counselors and Psychologists Act (No. 14 of 2014) Revised Edition 2019 [2014], directed that it should be struck off the Register; and
(b) any entry which has been incorrectly or fraudulently made in the register.
The Registrar may, with the written consent of the person, remove from the register the name of a person who has ceased to practice.
Every person registered who has obtained a higher qualification than when registered, shall be entitled to have that additional qualification inserted in the register in addition to the qualification previously registered upon application for change of registration status. Every such application shall be accompanied by the following:
a) Duly filled “Change of registration& license status” form(1D)
b) Certified copies of relevant academic certificate from recognized TIVET or university.
C) Receipt/proof of payment of change of license fees as specified in regulation no: 8.
8.Registration fees
A person eligible for registration under this Act as a counsellor or Psychologist shall pay a one-time registration fee as prescribed in the functions, services of the board and fees payable (2023) or as stated on the application form.
9. Publication of register
The Registrar shall publish in the Gazette as soon as may be practicable after registration the name of every counsellor or psychologist registered under the Counselors and Psychologists Act (No. 14 of 2014) Revised Edition 2019 [2014].
It shall be the duty of every counsellor or psychologist to inform the Registrar immediately of any change in the registered address.
The publication of the list of registered counsellors and psychologists in the Gazette shall be prima facie evidence that the persons named therein are registered under this Act, and the absence of the name of any person from such list shall be prima facie evidence that the person is not so registered.
10.License to Practice
A person shall be licensed to practice in accordance with sections 28-32 of the Counselors and Psychologists Act (No. 14 of 2014) Revised Edition 2019 [2014].
11. Process of Licensure
At the beginning of every calendar year a registered counsellor or psychologist shall electronically apply
for licensing using forms (2A,2B or 2C) to the Registrar for Licensing. Every such application shall be accompanied by the following:
a) Proof of minimum required units of continuous development as defined under the Counselors and
Psychologists (Continuing Professional Development) Regulations (2023/2024)
b) Receipt/proof of payment of registration fee as specified in functions, services of the board and fees payable
(2023)
For the purpose of the first Licensing of counsellors and psychologists, Counsellors and Psychologists already registered according to these regulations shall be exempted from the requirements of regulation 11(a) above.
